Why a well prepared VA claim still gets denied

The four denials on this page did not happen because the claim was thin. It was filed pre-discharge, every condition was documented in service treatment records, and somebody who does this for a living walked through it beforehand. Four still came back denied, all on the same line: the examiner indicated the veteran did not have and never had the condition.

That is worth understanding, because it is the failure almost nobody warns you about. A service connection claim has to establish three things, a current disability, an in-service event, and a medical link between them. Elements two and three were satisfied in writing. Element one is what the C&P exam tests, and it is the one that fails in a room, in a conversation, in front of somebody you met that morning.

A fifth was denied outright in error. Fixing it took a clear and unmistakable error argument, which is a narrow challenge available when a decision was wrong on the evidence and law in front of it at the time. Most veterans have never heard of CUE and would have eaten the denial or started over with a supplemental claim.
